Referral terms
Version dated 4 November 2026.
Referral terms
These terms apply to an accountant, bookkeeper, adviser or other business (the “Introducer”, “you”) that introduces an importer to the duty refund recovery service provided by Declaration Check, the trading name of a company in the course of incorporation in England and Wales as Falkenmark Services Group (company number and registered office will be shown here on registration) (“we”, “us”).
1. Introductions
1.1 An introduction counts when you register the importer with us through the Partners page, or by email to admin@declarationcheck.com, before that importer creates an account or uses the estimate, and the importer then engages us under our Engagement terms within 12 months of the introduction. An importer who is already registered with us, or who was introduced earlier by someone else, is not your introduction.
1.2 We may decline any introduction, and we may decline, pause or end any engagement under our Engagement terms; no referral fee is payable in either case.
2. Referral fee
2.1 The referral fee is the share of our fee stated in our written confirmation of your registration as an Introducer, calculated on the fee we actually receive from the importer on Amounts Recovered (as defined in the Engagement terms) under engagements starting within 12 months of the introduction. It is paid within 14 days of our receipt of the fee from the importer, on your invoice, plus VAT where applicable. No referral fee is payable on Duty Watch, Carrier Watch or software licence fees, on amounts we refund or credit to the importer, or where the importer does not pay us.
2.2 We tell every importer in our Engagement terms that an adviser who introduced it may be paid a share of our fee, that this does not change the importer’s fee, and that we will say who was paid on request. You will make the same disclosure to the importer yourself where the rules of your profession require it, and you will not accept a referral fee where those rules prohibit it.
3. What you may and may not do
3.1 You may describe our service to the importer using the material on our site and tell it how to run the free estimate on its own data. You will not give advice on our behalf, make any promise about what a customs authority will repay, handle any importer’s declaration data for us, or hold yourself out as our agent or representative.
3.2 Neither of us will offer, give or accept anything that would breach the Bribery Act 2010 or any equivalent law, and the referral fee is the only payment between us in connection with an introduction.
4. General
4.1 Either party may end this arrangement on 30 days’ written notice; referral fees on engagements already started remain payable. We may change these terms on 30 days’ notice for introductions made after the change.
4.2 We hold your contact details under our Privacy and data notice. These terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction, save that mandatory provisions of the law of the state in which you are established are not excluded. Questions: admin@declarationcheck.com.
